Unlocked engine covers caused BA emergency landing - regulator

LONDON (Reuters) - British air safety regulators ordered Airbus to notify operators of its A320 jets to make specific safety checks after finding unlocked engine covers had forced a jet to make an emergency landing at London's Heathrow airport last week.

An Air Accidents Investigation Branch (AAIB) report published on Friday said two coverings or cowls on the Airbus A319's engines were left unlatched after maintenance and this was not noticed before the aircraft departed.

All 75 passengers and five crew were unharmed after having been evacuated via the aircraft's emergency chutes following the Oslo-bound plane's emergency landing.

As a result of its investigation, the AAIB has formally requested Airbus notify operators of A320-family aircraft to check that the fan cowl doors are fully closed prior to flight by visually checking the position of the latches.

BA, whose own engineering team services its engines, said it would comply with the AAIB's recommendations. BA is owned by International Airlines Group.

"We are supporting the AAIB-led investigation and will follow its recommendations," Airbus said in a statement.

The AAIB said that prior to the BA incident there had been 32 reported fan cowl door detachment events by July 2012, 80 percent of which had occurred during takeoff.

The AAIB report said the fan doors from both engines of the BA jet detached during takeoff, puncturing a fuel pipe on the right engine and damaging the airframe and some aircraft systems. In turn this lead to a fire in the right engine on the approach to land.

It said fastening the fan cowl door latches usually required maintenance personnel to lie on the ground to reach the latches, and that the latches were difficult to see unless the person was crouching down.

BA's A319s are powered by two IAE V2500 engines made by the International Aero Engines consortium, part-owned by Pratt & Whitney parent UTC.

The AAIB said the BA plane's right engine was extensively fire damaged but the left engine continued to perform normally.

This contradicts findings made by America's National Transport Safety Board (NTSB), which on Thursday said the plane was forced to land after pilots shut down one engine, while the other caught fire.

PSA Dropbox is down for some

Dropbox is down -- break out the FTP client. According to readers and Twitter, the service has been out of action for just over half an hour and while you might see the green tick of syncing joy on your PC, we were still unable to upload any new files through both the internet and desktop iteration -- in fact the web interface is completely down. We're not sure if this is a server issue or perhaps a delicious new feature with teething issues, but we've reached out to Dropbox and will update when we hear back.

What does it do?

Why do we like it?

Whether or not you'll be a fan of Postcards depends very much on how you use Tumblr as a whole. If you like to casually pass through pages of GIFs, pictures, and short little quips, this app probably doesn't make much sense. But flicking side-to-side is a fun, intuitive way to change up how you interact with your dashboard. And for someone who uses Tumblr to discover reading material, the lack of features brings along a welcome lack of distraction from your desired content. You can't create new posts, though. Ms. Dill cites studies that show that sexualizing women in the media leads to low self-esteem in girls, and men ?exposed to sexualized, objectified images of women ... become more tolerant of real-life sexual harassment.? It seems fans? message may have gotten through. Media outlets reported that Disney quietly pulled the redesigned image of Merida from its website.

Me-centered generation

Joel Stein takes a critical look at the Millennial Generation ? those born between 1980 and 2000 ? in Time magazine. ?The Me Me Me Generation? headline implies that Millennial self-centeredness trumps even that of baby boomers. They were raised with greater resources than any preceding generation, are more tech savvy, and were nurtured by helicopter parents who, along with educators, told them they were special. And for better or worse ? they are.?

While Mr. Stein initially dwells on the studies that show Millennials have a sense of entitlement and are lazy, narcissistic, and dependent on their parents, he ultimately acknowledges a more nuanced, redeeming picture. Millennials may not tend toward traditional civic engagement, but they do care about justice. They are more tolerant than any other generation. Cold climate wind energy showing huge potential

May 28, 2013 ? Wind energy capacity is growing rapidly in the cold climates of the world. According to the latest forecasts, between 45 and 50 gigawatts of wind energy will be built in cold climates by 2017, which would mean an increase of as much as 72 per cent since the end of 2012 and investments amounting to approximately EUR 75 billion.

"This is a huge opportunity," says Research Scientist Tomas Wallenius from VTT Technical Research Centre of Finland. "There has been a lot of talk about the potential of offshore wind power, but the market for cold climate wind energy is more than ten times greater. We already have the tools to harness the potential of cold climate wind energy cost-effectively, while offshore wind energy is still at the research and development stage."

VTT has conducted the first ever study into the feasibility of building wind turbines across the globe in areas where cold climate and icy conditions place special demands on wind turbine technology. In addition to Scandinavia and Canada, these areas also include parts of Central Europe, the United States and China. The VTT study has been incorporated into the BTM World Market Update 2012 report (Navigant Research 2013). Cold climates represent encouraging potential for wind energy companies because of their sparse population and favourable wind conditions. These areas experience higher winds in winter than in summer, and the density of cold air increases production capacity. However, turbine blades are highly susceptible to icing. Although icing causes production losses of 3-10 per cent per year, losses can be reduced with the help of anti-icing systems.

The global financial crisis has made it more difficult to find funding for all kinds of energy investments. Nevertheless, both electricity producers and consumers are still interested in green energy. Wind energy also has the added benefit of predictability: production costs are easier to calculate in the absence of fuel price variations.

"Our research shows growing demand for anti-icing solutions, which are also developed by VTT in Finland. Another good example of a pioneer in this field is Labkotec Ltd, which is the global market leader in ice detection technology. Competition in this sector is fierce, but products and services for cold climates require specialist expertise which we in Finland have and which we can continue to develop. With good engineering, the challenges posed by cold and icy conditions can be overcome in a financially viable manner."

Striking green-eyed butterfly discovered in the United States

May 28, 2013 ? A new butterfly species from Texas, given the common name Vicroy's Ministreak, was discovered because of its striking olive green eye color, and was given a formal scientific name (Ministrymon janevicroy). This beautiful new butterfly may be the last truly distinctive butterfly species to be discovered in the United States.

Although individuals of Vicroy's Ministreak were deposited in the Smithsonian entomology collections a century ago, this species was unrecognized because it was confused with the common, similar-looking Gray Ministreak. Interestingly what distinguishes the two species is the distinctive olive-green eyes of the new species in contrast to the dark brown/black eyes of the Gray Ministreak.

As their common names suggest both species are diminutive, about the size of a thumbnail, and may occur at the same time and place. Besides eye color, each has different wing patterns and different internal structures. They have different, but overlapping, geographic distributions and habitat requirements.

Jeffrey Glassberg, President of the North American Butterfly Association, discovered Vicroy's Ministreak, and he named the species after his wife (Jane Vicroy Scott). Bob Robbins, the butterfly curator at the Smithsonian in Washington, DC, together with Glassberg, are the authors of the paper officially describing Vicroy's Ministreak, published in the open access scientific journal ZooKeys.

Regardless of whether Vicroy's Ministreak turns out to be the last truly distinctive butterfly to be discovered in the United States, the era of new butterfly species, which began with Linnaeus more than 250 years ago, is ending in the United States. In tropical America, however, there are still hundreds upon hundreds of butterfly species awaiting discovery.

EU duties on Chinese solar panels losing member: state support

BRUSSELS (Reuters) - A majority of EU governments oppose a plan to impose hefty duties on solar panel imports from China, a survey of member states showed on Monday, undermining efforts by Brussels to pressure Beijing over its trade practices.

The European Commission, the EU's executive, accuses Chinese firms of selling solar panels at below cost in Europe - a practice known as "dumping" - and plans to impose duties, making it far harder for China to gain market share.

The duties, averaging 47 percent, will come into force from June 6 for a trial period and could be withdrawn if both sides reach a negotiated settlement.

It is the largest trade case the Commission has undertaken, with about 21 billion euros of China-made solar panels sold in the EU.

The duties are being proposed by the EU's trade commissioner, Belgian lawyer Karel De Gucht, who met with Chinese Vice-Minister of Commerce Zhong Shan for an informal meeting in Brussels on Monday.

The Chinese side described the meetings as "constructive" and said the pair discussed solar duties as well as an EU threat to open an investigation into mobile telecom equipment makers Huawei and ZTE.

But Zhong said that either EU move would lead to a definitive Chinese response.

"Such practices of trade protectionism are not acceptable to China," a spokeswoman for the Chinese mission to the European Union said in a statement, and would "seriously sour the climate on bilateral trade and economic engagement."

"The Chinese government would not sit on the sidelines, but would rather take necessary steps to defend its national interest," if the EU went ahead, the statement said.

The fear of Chinese reprisal and potential loss of business has led Germany, Britain and the Netherlands to be among at least 14 member states to oppose the sanctions, diplomats told Reuters.

The Commission said China was pressuring some EU countries to oppose the duties.

"Commissioner De Gucht ... made it very clear to the Vice-Minister that he was aware of the pressure being exerted by China on a number of EU member states, which explains why they are positioning themselves as they are in their advisory positions towards the European Commission," the Commission said in a statement.

The EU's 27 countries had until last Friday to submit a formal, written response to De Gucht's plans. While the trade commissioner would still have the right to impose the duties, doing so in the face of member states' opposition would be hard.

The Commission statement said De Gucht told China's vice-minister he wanted "to examine the possibility of a negotiated settlement in partnership with the United States should this become necessary."

Provisional duties will more than likely still go ahead on June 6, once they are published in the European Union's official journal, officials say, but the pressure to roll them back before they become permanent in December will be intense.

The split underlines the depth of division in the EU over how to deal with China, a critical market for many EU exporters and the region's second biggest trading partner over all.

Reuters spoke to 21 of the EU's 27 countries and confirmed that 15 opposed the duties, while six supported them. The other six either declined to say or were unreachable.

France and Italy are leading a group of countries that say De Gucht is right to go ahead with sanctions, arguing that China's rapid rise in solar panel output to more than the world's entire demand could not have happened without illegal state support.

Chinese companies have captured more than 80 percent of the European market from almost zero a few years ago.

De Gucht met China's deputy commerce minister for informal talks in Brussels on Monday, a day after Chinese Premier Li Keqiang and German Chancellor Angela Merkel, meeting in Berlin, called for an end to the dispute, as well as another conflict over Chinese telecoms companies accused of dumping in Europe.

Germany initially supported De Gucht's plans for duties, and it was a German company, Solar World, that first raised the complaint against the Chinese.

But rather than punitive measures, Merkel now appears to favor a negotiated solution, wary of the potential impact on German exporters if China were to take retaliatory steps.

"There is no need for more sanction measures," German Economy Minister Philipp Roesler told a news conference on Monday after talks with Li.

TRADE CHIEF'S STRATEGY

Although De Gucht says he had no intention of damaging European business interests in China, he wants to show Beijing that the Commission is serious about preventing dumping and that China must play by international trade rules.

France shares that view.

"We want to see a balanced relationship between China and the European Union," said French Industry Minister Arnaud Montebourg. "Countries that use protectionism, and China is one of them, should accept reciprocal rules," he told reporters.

EU officials told Reuters earlier this year they were frustrated with the Chinese leadership's lack of engagement.

By levying provisional duties, the Commission feels it has leverage, because under EU law the sanctions could be cemented for up to five years from December if no solution is found.

According to a copy of the Commission's solar investigation obtained by Reuters, the Commission found clear evidence of dumping by Chinese producers.

"The Commission was presented with prima facie evidence that dumping occurred. They can't just ignore that," said Stuart Newman, a legal adviser to the Foreign Trade Association, a lobby group based in Brussels.

Church's chief exorcist urges Francis to allow all priests continue the rite

The Catholic Church's leading 'exorcist' is calling for all priests to be allowed to conduct the ritual after Pope Francis?apparently?performed one?in St Peter's Square last week, according to a report by the Mail Online, in Ucanews.?

Father Gabriele Amorth, head of the International Association of Exorcists, wants the current rules requiring all priests to obtain permission to perform exorcisms from their bishop to be relaxed.

Father Amorth, who claims he has carried out 160,000 exorcisms, said his request has been prompted by Pope Francis performing what he insists was an exorcism on a Mexican man ?possessed by four demons?.?

He told the Sunday Times: 'I will ask the pope to give all priests the power to carry out exorcisms, and to ensure priests are properly trained for these starting with the seminary. There's a huge demand for them.'

His comments come after Pope Francis was captured on film performing an apparent exorcism on May 19.?

The footage shows Pope Francis placing his hands on the head of a disabled man who appears to go into a frenzy of convulsions and shaking, before slumping as Francis prays over him.

Father Amorth, 88, told La Repubblica newspaper ?The Pope is also the Bishop of Rome, and like any bishop he is also an exorcist.?

Those who dismiss exorcism as superstition were wrong he insisted. ?There was now, more than ever, a need for exorcists to combat people possessed by ?sorcerers? and ?Satanists?.?

The Pontiff was introduced to two men in wheelchairs after Pentecostal mass on Sunday. When a priest leaned across to tell Francis something, the Pope's expression took on a serious tone.

Francis then took hold of the top of the man's head firmly, pushing him down into his wheelchair. As he delivered an intense prayer, the man's mouth dropped open and he heaved deeply half a dozen times, visibly shaking.

European stocks claw back ground as markets steady

LONDON (Reuters) - European stocks, bonds and the dollar traded in a calmer fashion on Monday after last week's turbulence, though another three percent dive in Japan's Nikkei kept investors on edge.

Last week's shakeout of equity, bond and currency markets was triggered by concerns the U.S. Federal Reserve could wind in its support sooner that had been expected, weak China data and doubts over how low Japan will allow the yen to go.

With UK and U.S. markets both closed for public holidays, European equity and bond markets saw a quieter than usual start to the week.

The FTSEurofirst 300 index of top European shares started up 0.3 percent as last week's falls tempted buyers, while demand for safe-haven 10-year German government bond futures eased.

The dollar was also steadier, though it dipped to 101.00 against the yen as the latest steep fall in Japanese equities saw investors continue to unwind their dollar hedges and head for bonds. The euro was little changed at $1.2940.

"Markets are currently experiencing difficulty fully and precisely understanding both the pace of global growth and the implications of central banks' activism," Credit Agricole said in a note.

"Expectations cannot remain stable for long and so investors should be prepared for periods of higher volatility in particular asset classes," they added.

In commodity markets, Brent crude slipped towards $102 per barrel, extending last week's 2 percent drop, as a weak economic outlook in a well-supplied market pressured prices. The broader market nerves also helped gold firm as it looked to build on last week's best run in a month.

Americans gather to honor fallen service members

ATLANTA (AP) ? Americans gathered at memorials, museums and monuments and the president laid a wreath at Arlington National Cemetery to honor fallen service members on Memorial Day, as combat in Afghanistan approaches 12 years and the ranks of World War II veterans dwindle.

"Let us not forget as we gather here today that our nation is still at war," President Barack Obama said after laying a wreath at the Tomb of the Unknowns.

"When they give their lives, they are still being laid to rest in cemeteries in quiet corners across our country, including here in Arlington," he said. He told the stories of three soldiers who had died. Each had been devoted to their mission and were praised by others for saving lives.

Hours later, veterans from conflicts from World War II to Afghanistan and Iraq gathered in Atlanta to dedicate a new veterans' park. Soldiers, airmen, Marines and seamen looked on as veterans and military family members sprinkled soil, sand and water from battlefields and waterways across the world.

Retired Army Lt. Col. Rick Lester called it "a reminder of our country's timeline of freedom." A 26-year veteran with multiple tours in Vietnam, Germany and Korea, Lester conceived the ceremony as a way to honor living veterans and those who never made it home.

The pilot recalled in detail the numbers of men lost on missions he flew in Vietnam. "All I can think about is how those were some of the greatest guys I ever met and what they would have done for this country once they got back," he said.

The soil and sand ranged from Revolutionary battlefields like Lexington and Concord to Tikrit in Iraq. There was none from the Civil War, Lester said, because "that was a time that our country was divided."

Battlefield remnants were mixed in a helmet Lester's father wore on D-Day in France in 1944. They were sprinkled from cups that his uncle, a Marine, used in World War II. His father lived. His uncle was killed in action.

Susan Jimison poured water collected from the Hudson River, Chesapeake Bay, Atlantic Ocean and Pacific Ocean.

Her brother, Mark Clotfelter, was a helicopter pilot shot down June 16, 1969, in Vietnam. The 22-year-old was later confirmed dead. Jimison was 14 at the time and recalled how a politically unpopular war affected the way her brother's death was treated. "Nobody talked about it," she said.

It wasn't until many years later that she started trying to learn about his military service and those who served alongside him. Now, she's married to a man, Michael Jimison, who flew with him, and she's writing a book about their company.

It's important, she said, for Americans to learn the personal stories behind military history and international conflict. "My brother died doing what he loved doing," she said.

New York Mayor Michael Bloomberg joined military leaders and others at the Soldiers' and Sailors' Monument in Manhattan. He later encouraged New Yorkers to celebrate the day and the good weather but also "remember the sacrifice that was made so that we could be here."

At the National World War II Museum in New Orleans, about 20 bicyclists clustered around veteran and museum volunteer Tom Blakey. The paratrooper in the 82nd Airborne Division jumped at Normandy on D-Day ? June 6, 1944 ? and in May 1945 helped liberate the work camp at Wobbelin in northwest Germany.

"Most of us wondered why we were there, killing people and being killed," he said. "We didn't do anything to deserve it. When we got to that camp and saw what was there, the lights came on."

The cycling group makes regular weekend training runs, and on Monday started a Memorial Day ride about seven miles away at the national cemetery in Chalmette, where the Battle of New Orleans ? the last in the War of 1812 ? was fought.

Once again aboard the historic USS Hornet, 83-year-old Dale Berven reflected on his tour of duty in Korea as a naval aviator as he took in the commemoration. As the bugle corps warmed up, Berven looked out from the now-decommissioned aircraft carrier docked in Alameda, across the bay from San Francisco, which ferried him around the world in a goodwill tour in 1954, the year after the Korean War ended.

At just 23 years old, Berven said he flew dozens of sorties as a lieutenant junior grade with the 91st Fighter Squadron.

"I was young and single, I had volunteered and I wanted to do that type of work," said Berven, now a docent at the USS Hornet Museum. "That is how people are now. They're not drafted, so you have 18-, 19-year olds who are giving up their lives for the freedom of this country. We ought to honor all those service men and women and not bring politics into it."

In South Sioux City, Neb., a statue honoring a Navy dog handler was unveiled in his hometown. The statue of Petty Officer 1st Class John Douangdara (dwung-DEHR'-ah) and his dog, Bart, is part of a five-acre dog park that's named for Douangdara. Douangdara died along with 29 other Americans in August 2011 when a military helicopter was shot down in Afghanistan.

Across much of New England, several days of heavy rain gave way to sunny skies for parades in towns large and small.

In Portland, Maine, kids and even pets displayed the Stars and Stripes as veterans, youth groups law enforcement officials and civic organizations paraded to Monument Square to the tunes of a marching band, sirens from a police car and the rumble of motorcycles.

For some veterans, it was a somber event.

Richard Traiser, a Marine injured when his tank came under attack in Vietnam, helped deliver a three-volley salute with the Marine Corps League.

Memorial Day gives those who served an opportunity to get together and remember friends who didn't make it.

"I think about them a lot, especially the people I lost in my platoon," Traiser said. "I don't dwell on it in a morbid way, but it's on your mind."

In Connecticut, a Waterford man who was killed in the Vietnam War was honored with a hometown park area named for him. Arnold E. Holm Jr., nicknamed "Dusty," was killed when his helicopter was shot down on June 11, 1972.

The holiday weekend also marked the traditional start of the U.S. vacation season. AAA, one of the nation's largest leisure travel agencies, expected 31.2 million Americans to hit the road over the weekend, virtually the same number as last year. Gas prices were about the same as last year, up 1 cent to a national average of $3.65 a gallon Friday.

At the American Airpower Museum on Long Island, N.Y., a program honored Women Air Service Pilots, or WASPs, who tested and ferried completed aircraft from factories to bases during World War II. Thirty-eight died during the war, including Alice Lovejoy of Scarsdale, N.Y., who was killed on Sept. 13, 1944, in a midair collision over Texas.

Women have made their way up the ranks in the regular military since then, exhibited in Wisconsin, with retired Air Force Maj. Gwen Sheppard becoming the first woman to serve as the grand marshal of the Milwaukee Memorial Day parade.

"It's very important that we recognize not only their contribution to American history, but women's history," said Julia Lauria-Blum, curator of the WASP exhibit at the museum. "These women really blazed a path. And most important, they gave their lives serving their country and must be honored like anyone else on Memorial Day."

Iran reform candidate says state TV cuts broadcast

TEHRAN, Iran (AP) ? The spokesman for a pro-reform Iranian presidential candidate says state television cut off his campaign broadcast unexpectedly, citing technical problems.

Mohammad Reza Aref is one of two pro-reform candidates cleared by the Islamic Republic's constitutional watchdog, the Guardian Council, to run in June 14 elections.

Most other approved candidates were hard-liners, while their most charismatic challengers, including centrist Akbar Hashemi Rafsanjani, were disqualified.

Witnesses say Aref's Monday campaign pitch on the Jam-e Jam channel was stopped 15 minutes after it started, while he was saying he would make use of Rafsanjani's "experience" if he became president.

Aref spokesman Hasan Rasouli spokesman said the candidate would seek "clarification" and ask that the program be rebroadcast.

Jam-e Jam, which is aimed at Iranians living abroad, could not immediately be reached for comment.

NTSB: Bridge collapse in Washington is wake-up call

SEATTLE (AP) ? The chairman of the National Transportation Safety Board said Saturday the bridge collapse in Washington state is a wake-up call for the nation.

"This is a really significant event and we need to learn from it, not just in Washington but around the country," Debbie Hersman said after taking a boat ride on the Skagit River below the dramatic scene where a truck bumped against the steel framework, collapsing the bridge and sending two vehicles and three people falling into the chilly water.

Investigators need to find out what happened in Washington and if it could be repeated at similar bridges around the country, Hersman said.

"At the end of the day it's about preventing an accident like this," she said.

Her team will spend a week to 10 days looking at the bridge, talking to the truck driver whose vehicle hit it, and examining maintenance documents and previous accident reports.

Other over-height vehicles struck the Skagit River bridge before the collapse on Thursday, she noted. Investigators are using a high tech 3-D video camera to review the scene and attempt to pinpoint where the bridge failure began.

Hersman does not expect the investigation to delay removal of debris from the river or work on a temporary solution to replace or repair the I-5 span. State and federal officials can, and will, work together on the investigation, she said.

They'll be watching for safety issues that could affect other bridges.

"The results can be very catastrophic," Hersman said. "We're very fortunate in this situation."

Washington state officials said Saturday that it will take time to find both short- and long-term fixes for the bridge that collapsed on Interstate 5.

While, the National Transportation and Safety Board finishes its inspection, state workers will begin removing debris from the river. Next, a temporary solution will be put in place to return traffic to Washington state's most important north-south roadway.

Inspectors are working to find out whether the disintegration on Thursday of the heavily used span over the Skagit River, 60 miles north of Seattle and 40 miles south of the Canadian border, was a fluke or a sign of bigger problems.

"These things take time. We want to make sure it's done right, done thoroughly," Washington Transportation Department spokesman Bart Treece said.

A trucker was hauling a load of drilling equipment Thursday evening when his load bumped against the steel framework over the bridge. He looked in his rearview mirror and saw the span collapse into the water behind him.

Motorists should not expect to drive on I-5 between Mount Vernon and Burlington for many weeks and possibly months, Treece said.

Treece asked people to plan for an extra hour to make their way through detours around the collapsed bridge. There are three detour options northbound and two options southbound.

About 71,000 vehicles use that stretch of highway every day. Late Saturday morning, traffic was moving freely through the detours.

"We're expecting it to get worse as the day progresses," Treece said, noting that at 11 a.m., the cloudy skies and cool weather could be keeping Memorial Day weekend travelers at home.

State transportation officials began working on both a temporary solution and a permanent fix within hours of the bridge collapse, he said.

The goal is to get I-5 open as quickly as possible, while making sure the solution is as safe as possible, he added.

Officials were looking for a temporary, pre-fabricated bridge to replace the 160-foot section that failed, Gov. Jay Inslee said Friday. That option could be in place in weeks. Otherwise, it could be months before a replacement can be built, the governor said.

Inslee said it will cost $15 million to repair the bridge. The federal government has promised $1 million in emergency dollars and more money could come later, according to Washington's congressional delegation.

State officials approved Mullen Trucking in Alberta to carry a load as high as 15 feet, 9 inches, according to the permit released by the state. However, the southbound vertical clearance on the Skagit River bridge is as little as 14 feet, 5 inches, state records show. That lowest clearance is outside of the bridge's vehicle traveling lanes, Transportation Department communications director Lars Erickson said Friday. The bridge's curved overhead girders are higher in the center of the bridge but sweep lower toward a driver's right side.

The bridge has a maximum clearance of about 17 feet, but there is no signage to indicate how to safely navigate the bridge with a tall load.

At a news conference later Saturday, Hersman said Washington state does not require signage unless the clearance is 14 feet, 4 inches or less.

The permit specifically describes the route the truck would take, though it includes a qualification that the state "Does Not Guarantee Height Clearance."

Vine, hip-hop and the future of video sharing: old rap songs and new ...

What does video tool Vine have in common with iconic rappers like the Beastie Boys and the Notorious BIG? More than you think. Like hip-hop, Vine is way to sample and collect culture ? and it may have to run the same legal gambit that rappers did a decade ago. If you haven?t tried it, Vine is a tool to make looping, six-second video clips and post them on social media or a website. The company, which is owned by Twitter, launched in January and its videos have already become a part of?the Tribeca Film Festival, the?U.S. Senate?and major marketing campaigns.

A new video mash-up culture

Vine exists because of new smartphone technology but it also replicates older forms of mashup culture. In particular, it mirrors what pioneering?hip-hop artists started to do in the 1980s ? taking sounds from myriad sources and sharing them through records like Paul?s Boutique and Ready to Die. Those hiphop records are aural tapestries that today stand as monuments to a new form of music and community. In the 2000s, however, Vine screenshotcopyright collectors came along and sued the rappers ? resulting in a drawn-out debate over where to draw a line between culture and intellectual property theft. Hip-hop ?largely prevailed but was damaged in the process. Now, a fight over a Vine video last month suggests history may repeat itself but this time, on the video front. The dispute involved the musician Prince using a law called the DMCA to?force Vine to take down?six-second concert clips posted by a fan. The fan didn?t oppose Prince?s takedown demand, meaning?no has ruled on whether a six-second clip actually infringes copyright. But if a court did look at the Vine case, the decision process would lead right through hip-hop.

In the 1990s, hip-hop artists called the sounds they use ?samples.? Copyright owners, however, called it theft instead and sued the musicians. The conflicts led to important court decisions about music, but whose principles apply equally to Vine. Notorious B.I.G.As the Disco Project explained in a thoughtful analysis?of the Prince case, the most relevant precedents involve the Notorious B.I.G. and the Beastie Boys. Both were involved in famous cases involving short samples. In the case of the Notorious B.I.G., a?Tennessee?court shut down store sales and radio plays of the late rapper?s ?Ready to Die? album, and a jury awarded $4 million in damages ? all over a three note horn riff. An appeals court, which had earlier written ?get a license or do not sample,? upheld the verdict in 2007. As law professor Tim Wu explained at the time, the case and others like it were especially absurd because the copyright owner was not even a musician but a one-man corporation who had obtained the music rights under shady circumstances. Fortunately, in the case of the Beastie Boys, a California appeals court took a more rational approach to the issue and ruled that a six second (the same length as a Vine video!) flute sample on the song ?Pass the Mic? didn?t infringe on copyright. The Supreme Court, in 2005, refused to reconsider the decision. The upshot, however, is that today we still don?t know for sure how long a sample can be before it infringes copyright. Twitter declined to comment on whether it believes Vine videos are covered by copyright law?s ?fair use? exception, but a source familiar with the company told me that the decision to make the videos six seconds long was not a coincidence.

Chilling our new visual culture

The trouble with Prince?s request to take down the Vine videos is not so much the disappearance of the videos themselves ? but instead that Vine and other forms of visual expression could meet the same fate as early hip-hop. Pauls BoutiqueWhen the Beastie Boys released their sample-stuffed 1989 masterpiece,?Paul?s Boutique, the law was still in a gray area and no one was suing hip-hop artists. That?s no longer the case.?As copyright scholars have explained, the threat of lawsuits and the astronomic cost of clearing samples means, today, no one could make an album like?Paul?s Boutique?in the first place. And that?s the danger posed by Prince. Right now, we?re enjoying a rich new age of images ? everything from Vine videos to BuzzFeed cat GIFs that are shared, recast and then shared again. If lawyers began to throw copyright grenades into this mix, these splendid strains of creativity could be quickly snuffed out. Does this mean that all Vine videos should be fair use? It?s hard to say. People are already using the platform to produce clever and original works of art ? the sort of thing copyright law is meant to reward. Likewise, big companies who use Vine for marketing have a case for using intellectual property law to protect their brands. It seems inevitable that these issues will get resolved sooner than later. The biggest task for now, though, is to find a way to do so without resorting to the harsher tools of copyright law, including the $150,000 damage demands that are a common feature of cease and desist letters. Congress is right now reviewing the Copyright Act. The process presents a perfect way to protect and foster this emerging age of?visual culture ? rather than try to smother it like hip-hop. Scandals Have ?Snowballed? Through the Obama Years and More May Be Coming, Rep. Blackburn Says

After a month in Washington where media focus was dominated by the Benghazi attack investigation, the?revelation?that the Department of Justice has been seizing the phone records of journalists and the IRS was unfairly targeting conservative groups - yet another scandal is brewing within the Obama administration, this time at the Department of Health and Human Services.

Rep. Marsha Blackburn (R-Tenn.) says the growing controversy involving?HHS Secretary Kathy Sebelius?trying to raise money from companies that her department regulates ranks among the major scandals that are plaguing the administration. The funds raised would go to nonprofits that help people enroll in and get excited about Obamacare.

"A lot of people have said it sounds like Iran-Contra -- to me, I think it's?probably?a little bit worse," Blackburn said in a video interview (below) with TheBlaze contributor Mallory Factor, who noted the difference to Iran-Contra where Oliver North raised funds for organizations he did not regulate.

As reported by?The Washington Post?earlier this month, Sebelius has been calling on health industry officials to make large?financial?donations to help implement ObamaCare after Congress repeatedly rejected administration requests for additional funding. Enroll America, a nonprofit group that the Post reports many of Sebelius's calls have gone to, is led by a former White house staffer.

Blackburn told TheBlaze that scandals have "snowballed" through the Obama years,?now coming to a head with the controversy surrounding the administration's actions leading up to and after the Sept. 11, 2012 attack on a U.S. consulate in Benghazi, the Department of Justice caught surveilling lawful media outlets like the Associated Press and Fox News, the Internal Revenue Service targeting conservative groups, and this latest controversy with Sebelius and the HHS. Blackburn told TheBlaze that she has even heard of?more whistleblowers set to step forward regarding scandals at the EPA.

Blackburn said that along with?colleagues?in Congress she will investigate these cases methodically and responsibly, subpoena individuals when necessary, and "make certain power grabs like this don't take place."

Tornado insured losses estimated at $2 billion-$5 billion

(Reuters) - Tornadoes that struck the United States from May 18 to May 20 caused anywhere from $2 billion to $5 billion in insured losses, disaster modeling company Eqecat said.

The firm said most of the losses were attributed to the tornado that devastated Moore, Oklahoma, last Monday.

Eqecat said some 76 tornadoes struck across 10 states over a three-day span. The worst of it was in Moore, where the firm said about 13,000 structures were damaged.

At the high end of the range, the outbreak may end up ranking as the second worst ever in terms of insured losses, behind only the late-April 2011 tornadoes that devastated Tuscaloosa, Alabama, and other communities.

Ever since the Samsung Galaxy S4 “Google Edition” announcement at Google I/O last week, rumors have been circulating that HTC might follow suit with a vanilla version of its own flagship device. Recently, Russell Holly of Geek.com and Paul O’Brien of MoDaCo have chimed in with reports that such a device is on the way. Today we can confirm through our own sources that despite official denials, the “Google Edition” HTC One is indeed real, and will be announced in the next week or so.

Stocks mixed as investors reassess Fed worries

(AP) ? Investors recovered their poise by midday Thursday after an early sell-off sent stocks sharply lower.

U.S. markets fell immediately after the opening bell following a global slump prompted in part by an unexpectedly weak report on manufacturing in China. Concern that the Federal Reserve might ease back on its economic stimulus program sooner than expected had also riled investors.

The dip gave investors who had missed this year's rally in stocks an opportunity to get into the market, and by midday stocks had recouped most of their early losses, even climbing slightly by midday.

"Most institutions, most hedge funds and most individuals have watched the market go up without them, so the dips are being bought," said Jim Russell, regional investment director at U.S. Bank. "There's a very strong case for U.S. stocks."

A pickup in hiring at U.S. employers, a recovery in the housing market and record profits at U.S. corporations have helped push the Dow Jones industrial average up 16.5 percent this year. The Standard & Poor's 500 index is 15.4 percent higher.

On Thursday, the Dow was up 24 points, or 0.1 percent, at 15,331 as of 2:21 p.m. Eastern Daylight Time. It had been down as many as 127 points in the early going following steep losses in European and Japanese markets.

The sell-off in global markets came after minutes from the latest Fed meeting, released Wednesday afternoon, indicated that several policymakers are leaning toward slowing the central bank's bond-buying program as early as June, sooner than many investors anticipated, if the economy continues to recover.

The central bank is spending $85 billion a month buying bonds. That program has been keeping interest rates low in an effort to encourage borrowing, spending and investing. It's also meant to encourage investors to buy risky assets like stocks.

Investors were unsettled by a report Thursday that showed manufacturing in China, the world's No. 2 economy, unexpectedly shrank this month. HSBC Corp. said the preliminary version of its monthly purchasing managers index had dropped to a seven-month low.

China's booming economy has been a major driver of global growth in recent years and investors worry when they see signs that it's slowing down.

Global stock markets fell sharply in Asia Thursday. Japan's Nikkei index dropped 7.3 percent after news was released about the slowdown in Chinese manufacturing. The sell-off extended to Europe, where Germany's DAX index, which has been at a record high, slid 2.1 percent.

Initially, the sell-off spread to the U.S., but it didn't last.

Some investors also judged Thursday that concern about the Fed easing, or tapering, its economic stimulus program was overdone.

Any pullback of the Fed's stimulus should be seen as a positive signal because it would mean that the U.S. economy is getting stronger, said Joe Quinlan, chief market strategist at U.S. Trust.

"When the Fed starts to taper, the fundamentals of the U.S. economy have improved even further than we have already seen," said Quinlan. "The Fed tapering is actually a good story for U.S. equities and the economy."

Encouraging news about the U.S. economy also helped the case for stock market bulls Thursday.

Sales of new homes rose in April to the second-highest level since the summer of 2008, the Commerce department reported Thursday. Also, the median price for a new home hit a record high, another sign that housing is recovering.

There was good news on the labor market, too.

The number of Americans applying for unemployment benefits fell 23,000 last week to 340,000, a level consistent with solid job growth. That suggests employers are laying off fewer workers. The decline in claims has coincided with steady job growth over the past six months.

In other U.S. stock trading, the Standard & Poor's 500 index was down three points to 1,652, or 0.25 percent. The Nasdaq composite fell three points, or 0.1 percent, to 3,459.

In commodities trading, the price of crude oil was flat at $94.28 a barrel. Gold rose $24.40, or 1.8 percent, to $1,391.80 an ounce. The dollar fell against the euro and the yen.

In U.S. government bond trading, the yield on the benchmark 10-year Treasury note edged down to 2.03 percent from 2.04 percent.

Among stocks making big moves, Ralph Lauren fell $4.36, or 2.3 percent, to $183.70. The apparel seller reported revenue that fell short of what financial analysts were expecting. Sluggish economic conditions and the decision to cut certain businesses reduced sales.

PC maker Hewlett-Packard surged $3.10, or 14.6 percent, to $24.32, after the company delivered second-quarter earnings that topped the estimates of both its own management and financial analysts.

Dollar Tree, a discount retailer, rose $2.12, or 4.36 percent, to $50.54 after it said that its earnings climbed 15 percent as customers spent more at its stores. The earnings beat the expectations of Wall Street analysts' that follow the company.

HP refreshes its laptops for back-to-school season, one has a 3,200 x 1,800 screen (updated)

With back-to-school season upon us and Intel's Haswell launch just around the corner, now's a great time for PC makers to start unveiling their summer lineups. Two weeks ago we heard from Sony and today it's HP's turn: the company just refreshed everything from its mainstream notebooks to its high-performance machines. Heck, even the pint-sized dm1 got a makeover. With the exception of that machine (now called the Pavilion TouchSmart Notebook), everything here will be offered with Haswell. There's a little something for everybody, and it's all waiting for you in a neat summary after the break. Join us as we break it down.

Update: We've added one more model to the list, and we think you're going to like it: an Ultrabook with a 3,200 x 1,800 display. HP hadn't meant to announce it today, but you know the internet -- sometimes the cat gets out of the bag anyway. In any case, we've added a quick blurb, as well as hands-on photos. Enjoy!

Anthony Weiner courts NYC voters: ?It?s a second-chance city, man!?

Mayoral hopeful Anthony Weiner made his first appearance on Thursday since declaring his candidacy, apologizing again for his bizarre, Internet-only infidelity scandal that forced him out of Congress nearly two years ago.

"There may be people who will never vote for me, and I respect that," Weiner told the phalanx of reporters who surrounded him outside a crowded Harlem subway stop. "If citizens want to talk to me about my personal failings, that's their right. I certainly will apologize."

Jason Rolom, a 31-year-old construction worker who lives in Harlem, was not one of those voters. Rolom posed for a photo with Weiner while on his way to work. "I know from the past that he had that scandal, but now he's here to help so I'm going to give him a shot," Rolom said. "Sometimes you've got to let go of the past."

Another man shook Weiner's hand on his way to the subway and exclaimed, "It's a second-chance city, man!"

Weiner, hands on his hips and smartphone strapped to his belt, told reporters he's "encouraged" by how willing voters have seemed to give him a second chance. His fellow politicians?and New York City's unforgiving tabloids?have so far seemed less receptive to his comeback attempt, however.

Sen. Charles Schumer, once Weiner's political ally and mentor, has stayed quiet on the announcement. "Shame on us," Gov. Andrew Cuomo said of the possibility that voters will put Weiner in office again. "I'm not asking people for endorsements," Weiner said on Thursday, adding that he wanted to prove himself.

Weiner announced his candidacy in a video posted on Wednesday to his website, saying he would attempt a political comeback for the first time since it was made public that he sent lewd photos to an unknown number of women over the Internet while serving in Congress. The announcement video appears to have been posted earlier than he intended, as it was removed for a while after it first appeared. Weiner also did not emerge from his apartment on Wednesday to address his announcement, another unusual feature of his mayoral campaign rollout. Huma Abedin, a longtime aide to former Secretary of State Hillary Clinton and Weiner's wife, appears in the video.

Despite the drama and scandal surrounding him, a recent poll shows Weiner is running second in the crowded race so far, after City Council Speaker Christine Quinn, who is widely expected to land Mayor Mike Bloomberg's endorsement. (One Harlem voter shook Weiner's hand and said he'd rather support him than "a woman." Weiner said he hoped he would vote for him for other reasons.)

The tabloids' love of his scandal has certainly boosted his name recognition in the city. Over the past two years, the New York Post has run nearly every single possible pun on the former congressman's unfortunate surname ("Weiner Roast," "Weiner Exposed," "Hard Time," "Fall on Your Sword, Weiner"). On Thursday, the more liberal Daily News jumped in, running an insert cover on Weiner's mayoral bid that exclaimed "HE'S GOT SOME BALLS." (A reporter brandished the headline at Weiner on Thursday morning, asking him how it made him feel.)

When Weiner resigned in 2011, the hard-charging congressman and liberal attack dog said he would seek "treatment," which apparently amounted to a three-day rehab stint in Texas. According to a recent profile in the New York Times Magazine, Weiner has spent "much of his time within a five-block radius of his apartment" on Park Avenue South, caring for his young son and plotting his next political move.

Weiner told the magazine why he thought the scandal?which involved no actual sex, just flirtatious messages and photos?exploded into such a national sensation. ?My last name; the fact that I was this combative congressman; the fact that there were pictures involved; the fact that it was a slow news period; the fact that I was an idiot about it; the fact that, while I was still lying about it, I dug myself in deeper by getting beefy with every reporter," Weiner said. "But it was also this notion of how much attention our relationship had gotten, this kind of Camelot feel to it. It turned out to make it harder on both of us, and it made the explosion that much bigger.?

Quinn, for her part, said she's not worried about the late entrant to the contest. ?I don?t care who enters the race,? Quinn told Crain's New York on Wednesday when asked about Weiner's announcement. ?Why should I talk about anyone but myself??

Israeli Man who Years Ago Helped Stop Terror Attack Shoots 4 Dead at Bank, Takes Hostage, then Kills Self at Bank Over a $1,600 DebtBank-Shooting

Customers and employees at a Bank Hapoalim branch in Beer Sheba, Israel were sure a terrorist attack was underway when they heard shots ring out Monday afternoon.

Instead, they were witness to what appears to have been a premeditated shooting carried out by an angry customer.

According to Israeli media, Itamar Alon, a 40-year-old unemployed customer of the branch, furious that he couldn't get his credit line extended, shot bank employees and customers, killing four and then taking another employee hostage before he killed himself.

Shortly after the branch opened Monday morning, Alon unsuccessfully tried to withdraw money from the ATM machine. He entered the bank to ask for a further line of credit in the amount of $1,640, but due to his large overdraft he was denied the request.

Israeli television and newspapers reported that Alon then went home where he grabbed his gun along with three magazines of ammunition. Police sources told Israeli media that the trip home along with the large amount of bullets demonstrated his premeditated intentions to carry out a lethal attack.

Upon returning to the bank, he shot dead the bank manager Avner Cohen, 44, who had just recently begun working in that position, his loan officer Meir Zeitoun, 40, and two customers Anat Even Haim, 34, and Idan Shnitzer Savri, 22.

An eyewitness told Israel Channel 2 that he saw Alon shoot some of his victims twice, making sure that they were dead.

After his shooting spree, Alon took bank employee Miri Cohen hostage. Cohen told Channel 2 that she had been hiding under the desk with two customers when Alon found her and pulled her to the bathroom into which he locked the two of them. From inside the bathroom, Cohen said she could hear police outside the window trying to negotiate with her captor.

Ynet reports:

Describing her ordeal, Cohen said the shooter warned her to stay silent else he will shoot her. "A second later the gun was drawn in my face," she recounted.

Locked in the bathroom with the shooter, Cohen was sure she would not escape with her life.

"Thank God, it was a miracle," she said. After an hour, Alon told her to turn around with her face to the wall. "I said 'that's it, this is the end of me,' and then I lowered my head and didn't look at him and he put the gun in his mouth, I couldn't see, but I heard a shot."

Following the hour-long standoff, Alon shot and killed himself after which Cohen ran outside to safety.

Israeli media quoted police sources who described Alon as a former captain in the border police and a former security coordinator for Beersheba schools.

He was once awarded a medal by the former mayor of Beersheba for showing bravery during a terrorist attack 11 years ago. The Times of Israel reports, "Two terrorists reached an army base in the south and opened fire on soldiers, killing several. Alon, then an officer in the army, rushed to the scene and returned fire on the terrorists, helping to kill one of them."

Because of his past work in the security field, Alon was eligible for a gun permit, though it had once been temporarily revoked. As in the aftermath of mass shootings that have occurred in the U.S., the issue of gun control is already being publicly debated. In Israel, there are tight limits on those who are licensed to own a gun. Only 2.5 percent of the population can legally carry a firearm, according to the Times of Israel, which describes the emerging debate:

In the wake of Monday's killings at a Beersheba bank [...] Israeli authorities intend to further tighten regulations to reduce the number of civilians eligible to keep guns, media reports said Monday night.

The killer, Itamar Alon, had a permit for the gun he used in the rampage, but had done no work that required such a permit for the past decade, Channel 2 news reported.

Alon had served in the IDF, receiving a citation for his role in preventing a terrorist attack in the city during the Second Intifada, then in the Border Police, and subsequently as a security officer for Beersheba educational institutions. But he had not worked in security for years, and was unemployed. "There was no reason for him to have been allowed to retain his gun permit," Channel 2 reported, quoting police sources.

Former police commissioner Moshe Karadi said Monday night that the bank killings marked one of the worst incidents of its kind in decades, but that the police are encountering a relentless rise in violent crime, and have been working for years to reduce the number of gun permits. Police sources quoted by Channel 2 said this effort would now intensify under the supervision of the Ministry of Public Security, which is in charge of both the police force and the licensing of civilian firearms, with Monday's killings serving to underline the imperative.

Extensive screening is required of those applying for gun permits, including a police background check and a medical form to be signed by a physician.

The Times of Israel reports, "The form consists of 24 questions, ranging from a patient's physical health to his or her history of substance abuse and psychiatric care. Some 170,000 Israeli citizens are licensed to carry a weapon; of these, 40,000 are security guards who work in supermarkets, malls and schools."

Israeli Prime Minister Benjamin Netanyahu says the shooting was a "tragedy." Though Israel has extensive experience with Palestinian terrorist attacks, the kind of mass shooting that occurred in the bank is rare. According to Israel Radio, Netanyahu said he "doesn't remember an incident like this, certainly not in the last few years."
