LA Probate Law Discusses Transferring Real Property into a Living Trust by Grant Deed

?

The popularity of living trusts, sometimes referred to as ?revocable trusts,? has steadily been increasing and becoming the preferred method of transferring property at death in many situations. The main advantage of a living trust is that it avoids probate, a court process that can be very expensive and time consuming. For many people, their most valuable asset is their home. In fact, many living trusts transfer only real property. The process for transferring real property to the living trust in California is fairly straightforward, but an attorney should be consulted before any transfer is finalized. Once we have finalized your revocable living trust, it is then time to ?fund? your trust. Funding your trust refers to the process of transferring your assets into the trust ? that is changing the legal title to all of your assets in order to conclusively demonstrate that the assets are held in trust. To transfer your assets into your living trust, LA Probate Law will prepare deeds for real property, and/or provide you with detailed instructions for the transfer of other assets such as bank accounts.

Affidavit Death

An Affidavit Death of a Trustee must be executed, notarized and recorded when a property owner that was a Trustee or Co-Trustee in a Living Trust passes away. When a property owner as a Trustee passes away, the Successor Trustee should contact a law firm to have this document prepared to list the the successor trustee in place of the Trustee in conjunction with the Trust name and date for ease in administration. (All of those real estate documents must be signed by somebody, and this is the successor trustee). This Affidavit Death of a Joint Tenant is recorded when a joint tenant (co-owner of property with right of survivorship) passes away to allow the remaining property owner to have full rights and control over the property that was held in joint tenancy. If a spouse dies and property is held in Joint Tenancy there will be no Probate, however, when the surviving spouse dies, and eventually he or she will, there will be a Probate ? it is just delayed. The property should be placed in a Revocable Living Trust to avoid Probate. An Affidavit Death of a Joint Tenant must be executed, notarized and recorded when a Joint Tenant passes away. People that are deceased are not allowed to own real property (or personal property) any longer. You can?t take it with you. Somebody must be in control of the real property?s disposition. This affidavit must be executed, notarized and recorded when a property owner passes away.

Preliminary Change of Ownership Document

All of the above should be recorded as soon as possible after executing and notarizing. For Affidavits, these documents require a notary Jurat not an Acknowledgment. Please do not make this mistake or you will end up preparing a new document. Call a law firm such as LA Probate Law and make sure this is done correctly. Mortgage or Title Companies will not have anything to do with you (due to liability) if the property is not a current transaction they are working on. All property must be recorded in the County where the property is located. If you own property in different States, your estate will have multiple Probates to deal with. The best way to avoid this is to create a Revocable Living Trust and make your Trust the owner of all of your properties, that is, if you have more than one property. A Trust Transfer Grant Deed can also create privacy if the Trust name is not your own name but is something like 450 Enterprise Trust, or LKT Trust, etc. There is no tax consequence for couples transferring property back and forth to one another for any reason; most do this for credit, re-finance or other reasons. There is also no tax consequence for transfers between parents and children or grand-parents and grand-children. However, beware ? there is a tax consequence for transfers between siblings.

Steps to Filing Out Information on Deed

Prepare a grant deed by filling out the blanks on the deed with the appropriate information. The deed must include the name of the grantor, the grantee?s name, and the legal description of the property, including the assessor?s parcel number. Name the trust as the grantee, such as ?Jane Doe, Trustee of the Doe Family Trust? for example states LA Probate Law. Prepare a ?Preliminary Change of Ownership Report.? A copy of the report is sent to the county tax assessor to determine whether the transfer triggers a property tax reassessment. Generally, transfers to revocable trusts do not trigger reassessment, but an attorney should be consulted to make sure. The report requires the name of the grantor, the name of the grantee, the property assessor?s parcel number and the address the property owner wants the tax bills sent to. The grantor must also sign the report. A blank report can usually be obtained at the county tax assessor?s office or at the county recorder?s office. Notify the mortgage lender if the property is subject to a due-on-sale clause in the note. A due-on-sale clause provides that the mortgage balance is due if the property is transferred. Direct the insurance carrier to name the trustee as an additional insured on the policy. Although not required, all communications with the insurance carrier should be in writing. Oral communications should be followed up with a confirmation letter.

A genetic study of thousands of specimens of sharks and rays has uncovered scores of potential new species and is fuelling biologists? debates over the organisation of the family tree of these animals. The work also raises the possibility that some species are even more endangered than previously thought.

Sharks and rays are key predators in marine ecosystems, but the life cycles and population numbers of many species remain poorly understood. The family tree of these animals ? which are part of the elasmobranch subclass ? has proved similarly opaque, with little agreement among researchers over their evolutionary relationships.

Gavin Naylor, a biologist at the College of Charleston in South Carolina, and his colleagues sequenced samples from 4,283 specimens of sharks and rays as part of a major effort to fill the gaps. The team found 574 species, of which 79 are potentially new, they report in the Bulletin of the American Museum of Natural History.

Naylor says that he was ?flabbergasted? by the result, especially because the sequencing covered only around half of the roughly 1,200 species thought to exist worldwide.

The huge number of new species found raises immediate conservation concerns ? the reason that some of these purported new species have gone undetected is probably their close resemblance to already-identified species. The populations of such species may, therefore, be even smaller than estimated, as what was thought to be one population may instead be several smaller populations of separate species.

For example, Naylor?s work suggests that the endangered scalloped hammerhead (Sphyrna lewini) is actually two separate species. ?Scalloped hammerheads in general have taken a huge hit, so it may be even worse than has been documented if there?s more than one species out there,? he says.

Naylor is now working on a project with the US National Science Foundation to catalogue the diversity of sharks and rays and is working to assist the International Union for Conservation of Nature to map which species are where in the world.

?This will have an impact on what is considered endangered and the fragility of different organisms,? he says. ?These are sentinel species of all sorts of other organisms in the sea which are probably undergoing similar or worse kinds of impacts.?

Circling the answer
One of Naylor?s collaborators, William White, an ichthyologist at the Australian Commonwealth Scientific and Industrial Research Organisation in Hobart, says that their work also highlights some of the problems with the use of genetic information in zoology.

The increasing use of molecular techniques provides a new means to scrutinize the relationship between sharks and rays, he says. But it also shows that some of the existing ideas about their relationships are problematic. ?Part of the problem is some researchers mining data blindly without a good understanding of where that data has come from in the first place and presuming the names are correct which in many cases they are not.?

White and Naylor stress that molecular techniques are only of one many available tools and should be combined with conventional taxonomic work.

Ximena V?lez-Zuazo is a biologist at the University of Puerto Rico in San Juan and the lead author of a 2011 paper² that Naylor says suffers from some of the flaws that stem from relying solely on molecular information. Though she strongly defends her group's work, she agrees that shark phylogeny is still a work in progress.

Obama prepping thousands of lawyers for election

OLYMPIA, Wash. (AP) ? President Barack Obama's campaign has recruited a legion of lawyers to be on standby for this year's election as legal disputes surrounding the voting process escalate.

Thousands of attorneys and support staffers have agreed to aid in the effort, providing a mass of legal support that appears to be unrivaled by Republicans or precedent. Obama's campaign says it is particularly concerned about the implementation of new voter ID laws across the country, the possibility of anti-fraud activists challenging legitimate voters and the handling of voter registrations in the most competitive states.

Republicans are building their own legal teams for the election. They say they're focused on preventing fraud ? making sure people don't vote unless they're eligible ? rather than turning away qualified voters.

Since the disputed 2000 presidential election, both parties have increasingly concentrated on building legal teams ? including high-priced lawyers who are well-known in political circles ? for the Election Day run-up. The Bush-Gore election demonstrated to both sides the importance of every vote and the fact that the rules for voting and counting might actually determine the outcome. The Florida count in 2000 was decided by just 537 votes and ultimately landed in the Supreme Court.

This year in that state alone, Obama and his Democratic allies are poised to have thousands of lawyers ready for the election and hope to have more than the 5,800 attorneys available four years ago. That figure was nearly twice the 3,200 lawyers the Democrats had at their disposal in 2004.

Romney has been organizing his own legal help for the election. Campaign attorney Ben Ginsberg did not provide numbers but said the campaign has been gratified by the "overwhelming number of attorneys who have volunteered to assist."

"We will have enough lawyers to handle all situations that arise," he said.

The GOP doesn't necessarily need to have a numerical counterweight to Obama's attorneys; the 2000 election showed that experienced, connected lawyers on either side can be effective in court.

Former White House counsel Robert Bauer, who is organizing the Obama campaign's legal deployment, said there is great concern this year because he believes GOP leaders around the county have pursued new laws to impede the right to vote.

"The Republican Party and their allies have mapped out their vote suppression campaign as a response to our success in 2008 with grass-roots organization and successful turnout," Bauer said. "This is their response to defeat: changing the rules of participation so that fewer participate."

Several states with Republican leaders have recently pursued changes that could make voting more difficult, including key states such as Florida and Ohio, despite objections from voting rights groups that believe that the laws could suppress votes from low-income and minority blocs.

Republicans dispute that the laws are political, pointing to cases of election fraud and arguing that measures like those requiring voters to show identification are simply common sense. Pennsylvania's Republican House majority leader, Mike Turzai, however, told GOP supporters over the weekend that the state's new ID law "is going to allow Governor Romney to win the state of Pennsylvania."

Independent from the Romney team, a conservative group is prepping an Election Day team of its own to combat possible fraud.

Catherine Engelbrecht, president and founder of True the Vote, said the organization hopes to train and mobilize up to one million volunteers this year, many of them to serve poll watchers. One of the group's main initiatives is to "aggressively pursue fraud reports."

"Being a poll watcher is an age-old tradition and we're fortunate that so many volunteers are ready and willing to take a day off, learn what they need to know and help out at the polls," Engelbrecht said. True the Vote already has thousands signed up to help and had 500 trained election workers monitoring the Wisconsin recall vote earlier this month.

"They serve as volunteer guardians of the republic, to ensure that procedures at the polls are in keeping with state law," she said.

It's one of the efforts that have Obama's team fretting. The Democrats fear that anti-fraud activity could get out of hand, with vigilante poll watchers targeting and intimidating voters who may not know their rights.

"We will have the strategy and the resources to address the threat and protect the voter," Bauer said.

The Obama-aligned attorneys, most of whom are not election experts by trade, undergo training and have materials to show them how to help at the polls on Election Day.

Charles Lichtman, who is helping advise the effort in Florida this year after leading it in the last two cycles, first created the Florida Democratic Lawyers Council after the 2000 election, vowing that there would never be a repeat of that disputed vote. He contends Democrat Al Gore would have won the presidency over Republican George W. Bush if a similar legal infrastructure had been in place then.

Lichtman's efforts have since been replicated for other states. He said that is vital to provide voter protection.

"My experience has been that, in every election, the other side has taken drastic measures to try to suppress the vote," Lichtman said. The volunteer organization has not been involved in the 2012 legal disputes so far, though they are monitoring the developments.

Four years ago, the teams of lawyers organized by Obama and Republican candidate John McCain in 2008 went largely unused since the election wasn't very close.

But this year may be different given all the changes to voting laws ? and the closeness of the race in recent polling.

The states with the strictest ID laws require voters to show photo identification before casting ballots. If they don't have proper identification or fail to bring it, they can cast a provisional ballot but must later go to meet with state elections administrators to sort things out before the ballot is counted.

Voting groups see a variety of potential problems, such as how voters are informed of the rule changes, how poll workers handle voters who fail to bring IDs and whether voters are provided adequate notice of the steps they need to take after casting an absentee ballot.

About 30 states have some form of an ID law, with varying methods of implementation.

Legal challenges typically start coming in the weeks before the election, but "litigation has started coming sooner and more vociferously" this year, says Edward Foley, an elections law expert with Ohio State University. That includes lawsuits surrounding Florida's plan to purge ineligible voters from the rolls.

Foley said. "We're in an era of increased litigiousness over the voting process."

He said lawsuits after Election Day may occur only if votes in a battleground state are within the "margin of litigation." That would probably be a difference of just hundreds of votes, a result that would be rare.

Florida Sen.?Marco Rubio (R)?is a fast-rising Hispanic political star. He won a seat on the West Miami City Commission in 1998, two years after graduating from law school. Two years later, this son of Cuban immigrants was elected to the Florida House, becoming its youngest speaker. In 2010, he defeated Florida's Republican governor to win a seat in the US Senate, where he is the second-youngest member. "At this point, I do.... We have about reached the point of no return on this issue. I think [the Justice Department has] been given multiple opportunities to answer very legitimate questions that the Congress has. We know for a fact that something they told the Congress was not true.... It's very legitimate for the Congress to inquire as to why we were told something that wasn't true.... And I think invoking executive privilege at the 11th hour [on June 20] was probably the last straw."

The visceral effect of the immigration issue for Hispanics:

"I call it a gateway issue, because for Hispanics, immigration is not a statistical debate. It is an issue regarding someone they know and probably someone they love."

Mitt Romney's stating that illegal immigrants should 'self-deport':

"I have never understood self-deportation ... as a policy. It is not a policy. It is an observation of what people will do in a country that is enforcing its immigration laws.... Some of that is happening now because of economic improvement in Mexico."

[I]t is important that we have a stable and affordable supply of domestic energy because ... it allows you to attract manufacturing in some sectors back to the United States.... Dangers of congressional gridlock:

"A day of reckoning is coming. We can ignore all these issues, but these issues will not ignore us. The US has a broken tax code, and if it doesn't fix it, our economy won't grow. The US has a problem with regulations,... we want our water to be drinkable, we want our air to be breathable,... but at the same time, if regulations become too difficult to comply with, people won't do business here."

On balancing his office with time for his four children, ages 4 to 12:

Who says wireless carriers can't be friends -- or, at the very least, can't exchange a bit of spectrum here and there? T-Mobile this morning let it be known that it has entered into a deal involving the "purchase and exchange" of spectrum licenses in 218 markets in the US. The magenta-tinged carrier says the deal will help improve its position in 15 of the US's top 25 markets and should help with next year's LTE rollout. All of this is pending regulatory approval, of course, some of which hinges upon Verizon's own license purchasing from the likes of SpectrumCo, Cox and Leap. 2 bombs in busy Baghdad market kill at least 9

BAGHDAD (AP) ? Two bombs tore through a market full of morning shoppers in northeastern Baghdad on Friday, killing at least nine people and wounding dozens more, authorities said.

The explosion came at midmorning in a market in the mostly Shiite Muslim neighborhood of Husseiniyah, where shoppers were buying goods before the heat of the day, a police official said.

The blasts were the latest in a fierce wave of attacks in Iraq in the past two weeks that has killed more than 125 people, mostly Shiite Muslims and government security forces.

The bloodshed highlights the struggle the Iraqi government faces in defeating al-Qaida-linked insurgents and staving off renewed sectarian warfare. The government itself is deadlocked over largely sectarian political conflicts.

Minutes later, a second bomb went off, apparently targeting police who had rushed to the scene.

The death toll was at least nine people dead and more than 50 wounded, a medical official said . Both officials spoke on condition of anonymity because they were not authorized to release the information.

In a separate attack earlier Friday, gunmen opened fire on a police checkpoint in western Baghdad, killing three officers, the police official said.

Only June? Northeast hits upper 90s for 2nd day

BOSTON (AP) ? Temperatures in the Northeast soared into the upper 90s for a second day Thursday as residents fled to pools and beaches, tourists reorganized their sightseeing itineraries and street vendors and store owners made a small fortune selling bottled water and other cold drinks.

New York's Central Park was forecast to reach a record 98 degrees. Boston, Philadelphia and Washington, D.C., will see similar heat with temperatures inching into the upper 90s and low 100s. The official first day of summer Wednesday set records from New York City to Burlington, Vt.

In the nation's capital on Thursday, a bit of resourcefulness has helped at least some tourists hit all the hotspots despite the scorching heat.

Nolan Shoffner, 36, who was vacationing in the city Thursday with his parents and 10-year-old son, Parker, said the family had rearranged some of their plans, like visiting the Lincoln and World War II memorials on Monday when it was cooler.

Since then, they've been doing outdoor activities like the White House and Capitol in the morning and saving cool, indoor museums for the afternoon.

"There's not a lot of places you can hide," Shoffner said of the heat as he stood outside the U.S. Capitol after taking a picture with his family.

In New Jersey, forecasters say temperatures could combine with humidity to make it feel like 110 degrees in parts of the state. Thermometers might not drop below 80 until the wee hours of Friday morning, they said.

American Idol hopefuls in Newark got a bit of a break from the heat. They were ushered inside Newark's Prudential Center on Thursday morning to register to audition.

The city has also opened cooling centers and its two public swimming pools.

Providence, R.I., which is expected to have a heat index as high as 102, is also operating cooling shelters and offer free public transit to discourage driving.

In preparation for the sweltering weather, golf course officials at the Travelers Championship in Connecticut have IVs ready to go at a medical tent where dozens were treated for heat exhaustion Wednesday.

Emergency medical services director John Quinlavin said people need to drink more water at the stations set up around the course. Forecasts for the area call for temperatures just short of 100 degrees.

"People are coming in dizzy, a little nausea, vomiting, generally poor feeling overall," he said. "We generally have a more mature audience here, and we do see a lot of the elderly having some problems with the heat."

With high heat and humidity forecast across the region, public health officials are warning residents to not leave pets or children in vehicles as temperatures can quickly escalate and lead to heat stroke and death.

Two dogs left in a hot pickup truck in western Massachusetts died as a result of the heat Wednesday afternoon.

Erika Mueller, a co-owner of South Deerfield Emergency Veterinary Hospital, said the well-meaning dog owner left the animals in the truck with a window open and a supply of water, but the temperatures soared into the 90s, which can surpass 100 in a vehicle.

Bashir Saleh, a Times Square food vendor, glanced at a tiny thermometer Thursday morning and looked up with a wry grin: The temperature in his cart was pushing 100.

"I'm exhausted," said Saleh, a native of Afghanistan who'd been working already eight hours as the heat rose near his propane-gas fueled coffee maker.

But it's worth it to him, he said. He makes more money on the hottest days selling iced coffee and other drinks.

Sporting a visor with an American flag, Saleh, who'd fled war in his native land, said that even when he's sweating to earn a living, "I think, God bless America. For a few days, I can sacrifice."

Right after I launched my blog in March, my friend Kayleigh emailed me and shared a story about her health and struggles with her weight. I really enjoyed the natural cocoa flavor, but more than that, I loved how full it kept me until dinner. Call me crazy, but I would throw in some coffee and make it a protein mocha for breakfast! I just told Kayleigh that I want to order a tub of Chocolate Herbalife Nutritional Shake Mix. This is a great post workout shake for busy days when I am short on time. I can?t wait to make some chocolate Protein Pancakes too!

I asked Kayleigh a few questions to give you guys a glimpse inside her HerbaLIFE!

1. Why did you start using Herbalife?
I was struggling with weight gain from a failing thyroid and adrenal gland and my regular healthy lifestyle wasn?t working the way it used to. I needed a jumpstart

2. How did you hear Herbalife?
I actually heard about it on the radio. I listen to Dr. Laura obsessively and she is does advertisements for Herbalife. After she had multiple coworkers loose upwards of 40 pounds using the shake, I decided I had to give it a try.

3. How long have you been using Herbalife?
I have been using it on and off for the past 9 months.

4. How many Herbalife shakes do you have per day? What do you usually eat in a day?
I vary between one and two shakes a day. It depends on how quickly you want to loose the weight. For the quickest easiest results its two shakes a day, but sometimes it doesn?t fit it my schedule or I don?t feel like eating two shakes.

Breakfast:
I almost always have a shake (the green one on my blog). That shake is a banana, Herbalife Forumla 1 Weight Loss Chocolate Powder, chia seeds, spinach, and a scoop of peanut butter.

Lunch:
I?ll normally make something. Maybe a big salad with all my favorites, a soup, a sandwich, a wrap or even leftovers. Pretty much anything that I can scrounge up quickly on my way to work or the night before if I have time. When I do have time I love to try new recipes and check out different ideas ? I love RFFMBT for that. It has given me some wonderful lunches that have kept me full till dinner time!

Dinner:
This is normally when I will have the second shake. I work out at night so this is my post workout shake. Either I?ll make the same shake I made in the morning (but nix the chia seeds ? they give you a ton of energy that have the potential of keeping you up later than you want to be up) or I?ll get a juice (Naked Juice Superfood is great or if you have a juicer that is awesome also) and mix it in with my Herbalife Formula 1 Vanilla flavored shake with some Glutacor to help with muscle re-growth.

Snacks:
I generally pack and bring with me wherever I am going that day. I?ll bring veggies, fruit and a protein. Everything varies based on the day but for proteins I either bring a bag of mixed nuts or an Herbalife Snack Bar (the lemon one is my favorite) I suggest getting creative with your fruits and veggies. You can eat as many as you want a day because they are just great for your system and you are supposed to have 8 servings a day anyhow so mix and match and use the veggies fill up if your having a mid meal craving or need for a munch fest!

5. How is Herbalife different from other nutrition/diet shakes?
I find that other shakes are either extremely expensive to purchase, not very good tasting, or had to work into your daily life. For me Herbalife is simple. It tastes delicious, it works wonderfully and I can add it to pretty much anything. I go and buy single small bottles of Naked Superfood Juice in bulk and then will bring it with me for the day if I?m out and about. It?s easy to shake up and drink. It doesn?t need a blender, it doesn?t need its own can. Got a craving for something sweet? Throw the chocolate flavored one in milk and drink up and you have a full meal of chocolate milk that will keep you full and energized all morning or afternoon! Its so simple and their are so many options and flavors.

6. How do you make your shake?
Depends on what kind of time I have. I?ll make the chocolate one with milk or water if I?m in a hurry. Or the vanilla with natural juice. When I?m home and I have my Magic Bullet Blender I will blend with ice and other yummy mix-ins. Sometimes fruits and veggies, sometimes peanut butter. Depends on my mood and day of the week, but your options are endless.

7. What is your favorite shake flavor?
Well, I love the chocolate because it fills my sweet tooth, but the vanilla is wonderful for adding to anything. Can I say there is a tie?

8. What is the average price of Herbalife? Where can I get it?
The price of the Formula 1 shake with shipping and handling and tax comes out to just a little over $48. It varies slightly on where it is being shipped to. Depending on the supplements you add, or if you want a workout protein powder as well (Herbalife 24 which is also great) those things vary.
